Is it illegal to make a vexel/vector art based upon a photo of Michael Phelps?

I am trying to raise money to go to the 2012 Olympic games. I want to make vector/vexel art and most likely sell it. Is is illegal to use a Michael Phelps photo as a reference for one of them?|||im not for shure
