Copyright for interface art in games?

I play world of warcraft and create interfaces for people to download and use quite often. It was brought to my attention that I may get in trouble if i use lets say the art from aion the tower of eternity to use in world of warcraft because of copy right laws. Is that correct? also is it true that when someone creates a program, picture, art that it is automatically copyrighted? thanks for the answers!Copyright for interface art in games?
Yes and yes.

When you create a "work", you automatically own its copyright. If someone else uses your work without your consent, they are in violation of copyright law. Likewise, if you use WOW artwork in your creations without their consent, you are in violation.

The easiest way to get around this is the "10% rule"...

Just alter the graphic enough so that it is different enough from the original. For example, change the color and/or orientation, apply graphical filters (such as blur or distort), etc.
